Welcome to Summit Homestead LLC. These comprehensive Terms of Service ("Terms") are designed specifically for any entity or person who accesses products, orders, or services from Summit Homestead, an Oregon limited liability company. By engaging with our dog training services, website, and associated products, you are bound by these Terms. If you do not agree to these Terms, please refrain from using our services.

The “Effective Date” of this Agreement is the date that Client first accesses the Products through the Website, linked content, or any of Summit Homestead LLC's online registration, provisioning, or order process.

If you receive free access to the Products, or you receive a Subscription or Trial Subscription to the Products, you are deemed a “Client” under this Agreement and are subject to its terms, including all restrictions and limitations.

This Agreement governs any Subscription to the Products from Summit Homestead LLC, access to the Website, and any other communications between Summit Homestead LLC and the Client, and sets forth the terms and conditions under which those Products will be delivered. This Agreement shall govern Client’s access to all Products whether or not they reference this Agreement.

You agree that from time to time Summit Homestead LLC may modify this Agreement by updating this Agreement on the Website. Upon such an update, the modified Agreement will become the Agreement ten (10) days after any such update unless formally rejected by Client in writing. To reject, Client must notify Summit Homestead LLC of such disagreement within the ten (10) day period. If Client continues accessing services, the Agreement as modified will then govern notwithstanding any such rejection.

Each party expressly agrees that this Agreement is legally binding upon it.

1. Services:

a. Online Memberships:

- Online memberships include access to a variety of digital content, training modules, and personalized virtual consultations. Membership details, including terms, fees, renewal policies, and cancellation procedures, are explicitly stated on our website or communicated during the signup process.

b. In-Person Services:

- In-person services encompass dog training sessions, workshops, and related activities conducted either at our designated facility or at agreed-upon venues. Specifics such as scheduling, fees, cancellation policies, and additional requirements will be clearly communicated in advance.

2. Agreement:

a. Online Memberships:

- Subscribing to our online memberships constitutes an agreement to adhere to the terms outlined on our website. This includes but is not limited to payment obligations, membership duration, and any automatic renewal conditions. Members retain the right to cancel their memberships, as stipulated in our cancellation policy.

b. In-Person Services:

- Engaging in in-person services requires a separate agreement detailing the specifics of the service. This includes, but is not limited to, the date, time, location, training objectives, fees, and any other relevant terms. Payment for in-person services is due before the scheduled session, as outlined in the agreement.

3. Property:

a. Online Content:

- All digital content, materials, and resources provided as part of online memberships are the exclusive intellectual property of Summit Homestead LLC. Members are granted personal, non-commercial use rights for these materials. Unauthorized reproduction, distribution, or commercial use is strictly prohibited.

b. In-Person Sessions:

- Participants in in-person training sessions must respect the property, facilities, and equipment used for the sessions. Participants are financially responsible for any damages to property caused by their negligence or the actions of their pets.

4. Liability

a. Assumption of Risk:

- Participants in in-person training sessions acknowledge and assume the inherent risks associated with working with animals. They take full responsibility for any injuries or damages caused by their pets during the training sessions.

b. Limitation of Liability:

- To the extent permitted by Oregon law, Summit Homestead LLC is not liable for any injuries, damages, or losses incurred during or as a result of our training programs, both online and in-person.

5. Termination:

- Summit Homestead LLC reserves the right to terminate access to our services for any violation of these Terms or any inappropriate conduct. In the case of online memberships, termination may result in the immediate loss of access to digital content and materials.

6. Governing Law:

- These Terms are governed by and construed in accordance with the laws of the state of Oregon. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Oregon.
